Luis CA, who was born in Argamasilla de Alba (Ciudad Real) lived in a dilapidated house in Rentería (Basque Country). According to the Prosecution, the assailant visit him with another person to ask about an alleged assault that happened days before and who had suffered his brother. Prosecution form says that the two men assaulted the victim and the older of them began to attack the homeless with kicks and punches. Always according to the Prosecution, as a result of the beating, Luis C.A. suffered various injuries, including a ruptured spleen that caused his death. According to the defendant, the victim had stolen some belongings to his brother and the attacker lost control when he saw Luis C. A. but in no case he would cause death on him. However, Private Prosecution stated that the accused clearly intended to kill the victim and also did it with cruelty and in obvious treacherous ways.
